1. Our Stance on Spam
Nabtech Digitalnet Limited ("Nabtech") maintains a zero-tolerance policy towards the sending of unsolicited commercial communications, commonly known as "spam." We are committed to fostering a secure, responsible, and trustworthy online environment for our customers and the internet community at large.
This Anti-Spam Policy outlines our strict requirements for any customer using our services to send bulk or commercial electronic messages. Violation of this policy is a material breach of our Terms of Service and will result in immediate and severe penalties, including account termination without refund.
2. Definition of Spam
Spam is defined as any unsolicited electronic message sent for a commercial purpose. This includes, but is not limited to:
- Sending emails or other messages to recipients who have not explicitly requested to receive them from you (unsolicited).
- Sending messages in bulk to a large number of recipients simultaneously.
- Posting off-topic, promotional, or repetitive messages to online forums, guestbooks, newsgroups, or chat rooms.
- Using email lists that have been purchased, rented, or acquired from a third party where the recipients did not explicitly consent to receive messages from you.
This policy applies to all services provided by Nabtech, including our shared hosting, VPS, dedicated servers, and NabtechCompute accounts.
3. Consent & Permission: The Core Requirement
The fundamental requirement for sending bulk or commercial email is **explicit, verifiable consent** from the recipient. You must be able to prove that every recipient on your list has knowingly and willingly agreed to receive communications from you.
3.1. Opt-In Confirmation (Double Opt-In)
All mailing list subscriptions must be confirmed through a double opt-in process. This means:
- A user subscribes through a form on your website.
- A confirmation email is automatically sent to the user's provided email address. This email must contain a unique link that the user must click to confirm their subscription.
- The confirmation email must clearly state the purpose of the mailing list and link to your privacy policy.
3.2. Verifiable Consent Records
For every subscriber on your list, you must maintain clear and accurate records of their consent. Nabtech reserves the right to request this information at any time. These records must include:
- The subscriber's email address.
- The exact date and time of their subscription confirmation.
- The IP address from which the confirmation was made.
- The specific form or source of the subscription (e.g., "Homepage Newsletter Signup").
4. List Management & Acquisition
4.1. Prohibited List Sources
The use of email lists obtained from the following sources is strictly prohibited on the Nabtech network:
- Purchased or Rented Lists: You may not use lists bought or rented from third parties. The recipients on these lists did not consent to hear from you specifically.
- Third-Party Lists: You may not use lists shared or provided by a partner or other organization.
- Harvested Addresses: You may not use email addresses collected or "scraped" from websites, social media, or other public sources.
4.2. Conditions for Using Acquired Lists
In the rare event that a list is acquired as part of a legitimate business acquisition (e.g., buying a company), you may only use that list if you can prove that the original consent is still valid and transferable. All subscribers from such a list must be sent a notification of the change in ownership and given the opportunity to re-confirm their subscription or easily opt-out.
5. Required Mailing Practices
All bulk or commercial messages sent using Nabtech's services must adhere to the following practices:
5.1. Accurate Message Headers
You must not falsify, obscure, or alter message headers in any way to conceal the origin of the message or the sender's identity. "From," "To," and "Reply-To" fields must be accurate and identify the sender.
5.2. Functional Unsubscribe Mechanism
Every email must contain a conspicuous, clear, and fully functional "unsubscribe" link. This link must allow a recipient to easily opt-out of all future mailings. Unsubscribe requests must be honored promptly, within a maximum of 5 business days.
5.3. List Hygiene and Bounce Handling
You must actively manage your mailing lists to remove undeliverable addresses. Any email address that results in a hard bounce (i.e., a permanent delivery failure) must be immediately and permanently removed from your list. An excessive bounce rate may result in suspension of your sending privileges.
5.4. Physical Address
Every email must include the valid physical postal address of the sender.
6. Prohibited Content & Actions
- Spamware: The use of any software designed to facilitate spamming or harvest email addresses is strictly forbidden.
- Inappropriate Public Posts: You may not post predominantly promotional messages to public forums, newsgroups, or guestbooks unless the service operator explicitly permits it and the content is on-topic.
- Affiliate Responsibility: You are fully responsible for the mailing practices of any affiliates or third parties you authorize to promote your services. Their actions are considered your own.
7. Enforcement & Consequences
Nabtech actively monitors its network for abuse. We reserve the right to take any of the following actions at our sole discretion, without prior notice, in response to a suspected violation of this policy:
- Immediate Account Suspension or Termination: Any account found to be involved in spamming will be immediately suspended or permanently terminated without the possibility of a refund.
- Email Limitation: We may impose limits on the number of email addresses that can be created or the volume of email that can be sent from any account.
- Investigation Cooperation: You must respond to all inquiries from Nabtech personnel regarding spam complaints within 72 hours. Failure to respond may result in account deactivation.
- Cleanup Fees: We reserve the right to charge a fee for any costs incurred in handling spam-related issues, such as time spent cleaning up blocklists.
8. Reporting Spam
If you have received an unsolicited email from a Nabtech customer, please report it to us immediately. Forward the complete email, including all original headers, to abuse@nabtech.co. We take all complaints seriously and will investigate thoroughly.
